In these Terms and Conditions “we, our, us, Colourcom” refers to Colourcom Limited.

ACCEPTANCE OF TERMS

By accessing the content of www.colourcom.com (“the Website”) you agree to be bound by the terms and conditions set out herein and you accept our privacy policy.  If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately.

You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

MODIFICATION

Colourcom reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

Colourcom have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

LIMITATION OF LIABILITY

Colourcom will under no circumstances be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.

Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of Colourcom it’s employees or agents.

COPYRIGHT

All intellectual property of Colourcom and its partners such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of their respective owners.

By using the Website you agree to respect the intellectual property rights of Colourcom and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website.

DISCLAIMERS

The information is provided on the understanding that the website is not engaged in rendering advice and should not be wholly relied upon when making any related decision.

The information contained with the Website is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website.

We do not guarantee uninterrupted availability of the www.colourcom.com Website and cannot provide any representation that using the Website will be error free.

We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

GOVERNING LAW AND JURISDICTION

This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Colourcom Returns Policy
If you would like to return an item because it is faulty, damaged in transit or because we have sent you the wrong goods or because you ordered it by mistake then please call us immediately on 01235 797140 or you can email returns@colourcom.com.
For Faulty or Damaged Goods or Goods Supplied in Error:
Please put ‘Return of Goods’ in the subject line and the following information in the main body of your message, or have the following information to hand when you call us:
1. Your PO number, sales order number, delivery reference number or our invoice number
2. The item product code and description
3. Your reason for returning the item (eg damaged/faulty/supplied in error)
4. Your name, company name, contact telephone number and address for collection of the item

Colourcom will then supply you with a returns number and form to fill in. Please note the following for the return of faulty, damaged or supplied in error goods:

  • Returning goods must be accompanied by a Returns Form with a Returns Number (we will give this to you)
  • Colourcom will credit delivery charges incurred and pay collection costs of returning goods to us if items are returning because of an error on our part or if they are damaged/faulty, in accordance with our returns policy.
  • Replacement goods will be issued once the returned item has been received.
  • All goods deemed to have been damaged in transit or faulty will be replaced on a like-for-like basis and credits will only be issued at our discretion.
  • Colourcom will check all returns for damage or faults. In the event that we can find no damage or fault, we reserve the right to withhold the credit for the item.
  • In the case of larger items such as but not exclusively, printers, laminators or scanners, a member of the Colourcom team will call to discuss the cause of the fault or extent of the damage before authorising a replacement product.
Colourcom cannot be held responsible for goods damaged or rendered faulty by misuse or Acts of God. We also do not accept responsibility for damage caused to any equipment or persons through continued use of faulty goods.
For Goods Ordered Incorrectly:
If you make a mistake when ordering either ordering too many or ordering the wrong product or you no longer require the items, please call us immediately on 01235 797140 or e-mail returns@colourcom.com. Please put 'Return – Unwanted Item’ in the subject header. Please note that we cannot accept the return of any product that has less than 6 months left before the expiry date. Please include the following information in the body of your mail:
  1. The product code and description of the item(s)
  2. Your reason for return (unwanted/incorrectly ordered)
  3. Date received
  4. Our invoice number, your PO number or our delivery note number
  5. Your name, company and contact telephone number

Colourcom will then issue you with a returns number and form. Please note the following details for such returns:
  • All goods to be returned must be accompanied by a Returns Form (we will issue this to you on receipt of your phone call or e-mail as above)
  • We reserve the right to charge a restocking fee of 20% of the total list price of the Goods (minimum charge £20.00). Goods must be returned carriage paid to Colourcom, in original unmarked packaging, complete, unused and with Returns Number attached to the outside of the packaging in a non-destructive manner.
  • The goods must be returned in a saleable condition, ie, original, undamaged packaging. Goods that have been opened and re-sealed will not be accepted.
  • Once Colourcom has received the goods and deemed them to be in saleable condition, your account will be credited the net value less the handling fee.
  • Your application may be rejected if you fail to comply with the terms stated above.

 
Please note that all goods remain the property of Colourcom until we have received payment in full, as cleared funds for the goods and any other outstanding funds that are also due for payment by the Customer to Colourcom.
